Terms of Service

These Terms of Service ("Terms") govern your use of Simon HQ and related services operated by Up Access ("we", "us", or "our"), including tools that help you create, schedule, and publish short-form video clips to third-party platforms such as TikTok (via our self-hosted Postiz integration).

1. Acceptance

By accessing or using Simon HQ, you agree to these Terms. If you do not agree, do not use the service.

2. The service

Simon HQ is a workspace for managing AI-assisted workflows, media clipping, and social publishing. Features may include connecting social accounts (including TikTok through Login Kit and Content Posting API), uploading or generating media, scheduling posts, and publishing content you authorize us to send on your behalf.

3. Accounts and eligibility

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. Access may be limited to invited or authorized users of a workspace.

4. Connected platforms (including TikTok)

When you connect a TikTok or other social account, you authorize Simon HQ / Postiz to access the permissions you grant (for example profile information and video upload/publish capabilities) solely to provide the features you request. You must comply with each platform's terms, community guidelines, and developer policies. We do not control TikTok or other third-party platforms and are not responsible for their availability, review decisions, or content policies.

5. Your content

You retain ownership of content you upload or publish. You grant us a limited license to process, store, transmit, and display that content as needed to operate the service (including delivering media to TikTok or other platforms you select). You represent that you have all rights needed to use and publish the content and that it does not violate law or third-party rights.

6. Acceptable use

You agree not to:

• Use the service to spam, harass, deceive, or distribute illegal or harmful content
• Circumvent platform limits, rate limits, security controls, or audit requirements
• Misrepresent the source of AI-generated or edited media where disclosure is required
• Attempt unauthorized access to systems, accounts, or data that are not yours

7. Availability and changes

We may modify, suspend, or discontinue features at any time. The service is provided on an "as is" and "as available" basis without warranties of uninterrupted or error-free operation.

8. Limitation of liability

To the fullest extent permitted by law, Up Access and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of content, profits, or data arising from your use of the service or from third-party platforms.

9. Termination

We may suspend or terminate access if you violate these Terms or create risk for the service or others. You may stop using the service at any time and disconnect third-party accounts from within the product or the platform settings.
